GATE RECYCLING PLATFORM: MASTER TERMS OF SERVICE

NOTICE TO USER: THIS IS A LEGALLY BINDING AGREEMENT. BY ACCESSING, VIEWING, OR UTILIZING THE GATE RECYCLING PLATFORM (THE "PLATFORM"), YOU UNCONDITIONALLY ACCEPT AND AGREE TO BE BOUND BY THE TERMS SET FORTH HEREIN. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, CEASE ALL USE IMMEDIATELY. UNAUTHORIZED ACCESS CONSTITUTES A TRESPASS TO CHATTELS AND A VIOLATION OF INTERNATIONAL CYBERSECURITY STATUTES.

1. NATURE OF SERVICE & DISCLAIMER OF WARRANTY

Gate Recycling provides a proprietary repository of electronic component data, catalytic converter valuations, and market-based pricing heuristics.

  • Informational Purposes Only: All pricing data provided is indicative and non-binding.

  • As-Is Basis: The Platform is provided "As-Is" and "As-Available." Gate Recycling expressly disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or absolute synchronization with global commodity fluctuations.

  • No Financial Guarantee: Users acknowledge that financial outcomes resulting from the application of Platform data are the sole responsibility of the User.

2. INTELLECTUAL PROPERTY & PROPRIETARY RIGHTS

The Platform, including its underlying source code, pricing algorithms, data structures, UI/UX design, and metadata, constitutes the exclusive Intellectual Property of Gate Recycling.

  • Scope of License: Users are granted a limited, non-transferable, revocable license to access data for internal use only.

  • Prohibited Acts: You are strictly forbidden from copying, scraping, extracting, or reproducing any data via manual or automated means (e.g., bots, crawlers, or AI-driven harvesters).

3. IRREVOCABLE PROHIBITION OF REVERSE ENGINEERING

Any attempt to decompile, disassemble, or reverse-engineer the pricing logic, backend APIs, or proprietary algorithms of Gate Recycling is a material breach of this contract.

Legal Warning: Any effort to circumvent security protocols or analyze internal system architecture will be prosecuted to the maximum extent permitted by law, including claims for trade secret misappropriation.

4. SECURITY, MONITORING, AND FORENSIC LOGGING

To ensure the integrity of the Platform, Gate Recycling employs aggressive monitoring protocols.

  • Data Collection: We reserve the right to log IP addresses, device fingerprints, and real-time access patterns.

  • Enforcement: Any behavior deemed suspicious, including rapid-fire queries or unauthorized API calls, will trigger immediate, irreversible account termination.

  • Indemnification: You agree to indemnify Gate Recycling against any damages arising from your unauthorized attempt to bypass our access control systems.

5. SUBSCRIPTION & ACCOUNT INTEGRITY

  • Confidentiality: Users bear absolute liability for maintaining the confidentiality of their credentials.

  • No Sublicensing: Sharing accounts or distributing premium data to non-subscribers is strictly prohibited and constitutes a breach of contract and theft of service.

  • Unilateral Termination: Gate Recycling reserves the right to restrict or terminate access at its sole discretion, without prior notice, for any suspected violation of these Terms.

6. LIMITATION OF LIABILITY

In no event shall Gate Recycling, its officers, or its affiliates be liable for any direct, indirect, incidental, or consequential damages—including, without limitation, loss of profits, market volatility losses, or data misinterpretation—arising out of the use or inability to use the Platform. Use of the Platform is at your own peril.

7. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Gate Recycling is incorporated, without regard to conflict of law principles. Any legal action arising hereunder shall be litigated exclusively in the courts of said jurisdiction.

8. SEVERABILITY & INTEGRATION

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between the parties regarding the subject matter hereof.

BY PROCEEDING, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREED TO BE BOUND BY THESE RIGOROUS LEGAL STANDARDS.
